Terms of service

Agreement to Terms 

By downloading, installing, or using the Exhaust Expert mobile application and related services (collectively, the “Services”), you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Services. 

If you use the Services on behalf of a business or other organization, you represent that you have authority to bind that organization, and “you” includes that organization. 

These Terms work together with our Privacy Policy Where they conflict on privacy matters, the Privacy Policy controls. 

Description of Services 

Exhaust Expert provides a business-to-business (B2B) platform for authorized users, including: 

  • Customers — vehicle lookup (VIN and year/make/model/engine), product discovery, cart and ordering, order and delivery tracking, returns (RMA), support tickets, profile and address management, and notifications. 

  • Sales representatives — customer and order visibility, RMA handling and messaging, and related sales tools within their assigned scope. 

  • Administrators and warehouse administrators — user and shop management, product and inventory tools, order and delivery oversight, RMA review and refunds, support ticket handling, account request review, and operational dashboards. 

Ordering, payment, and refunds are integrated with Shopify and related commerce systems. Delivery may be coordinated through third-party carriers or delivery partners (including providers such as DoorDash and Roadie). Support may be provided via in-app tickets, RMA messaging, email, and push/in-app notifications. 

Eligibility and Account Access 

Account requests 

New customer and sales representative accounts are created through an account request process. Requests are reviewed by an administrator before access is granted. You must provide accurate information (name, email, location, and optional phone where requested). 

  • Customers must use an individual work email. You may not use an email already registered as a shop’s shared account email. 

  • You must accept these Terms and our Privacy Policy when submitting an account request. 

Until your request is approved, you may not have full access to ordering or other restricted features. 

Login and security 

Access may use phone number verification (OTP) and/or email and password, as enabled for your account. You must keep credentials confidential and are responsible for activity under your account. 

We may suspend, deactivate, or block accounts for misuse, failed login policies, security risk, inactivity, or violation of these Terms. Temporary passwords issued by administrators expire after a limited period and must be changed when required. 

Roles 

Features depend on your assigned role (for example, customer, sales representative, administrator, or warehouse administrator). You may not access features or data outside your role or authorization. 

Acceptable Use 

You agree to use the Services lawfully and only as intended. You must not: 

  • Attempt unauthorized access to accounts, APIs, systems, or data. 

  • Misrepresent your identity, role, or affiliation. 

  • Abuse ordering, returns, support, or account workflows (including fraudulent or repetitive RMA or deletion requests). 

  • Upload unlawful, harmful, or misleading content (including false return evidence). 

  • Interfere with or disrupt the Services, other users, or integrated partners. 

  • Reverse engineer, scrape, or misuse the app or backend except as expressly permitted. 

  • Circumvent approval, checkout, or return eligibility rules. 

Orders, Checkout, Delivery, and Payment 

Orders and checkout 

  • Only approved customer accounts may complete checkout. Guest checkout is not supported. 

  • Cart and checkout are processed through Shopify (Storefront/checkout). Pricing, taxes, fees, and availability may change and are confirmed at checkout. 

  • Orders are subject to acceptance, stock/warehouse availability, and operational review. 

  • Order confirmations, status updates, and related communications may be sent by email, push notification, and/or in-app notification. 

Delivery 

Delivery options, timing, and fees depend on your location, cart contents, warehouse rules, and third-party delivery partners. Estimated delivery times are not guaranteed. Delays may occur due to carrier/partner capacity, weather, address issues, or other factors outside our control. 

Delivery-related line items (for example, delivery or service fees shown in order summaries) are handled according to your order and return policies below. 

Payment and cancellations 

Payment processing is handled by Shopify and its payment providers. Order cancellation and refund outcomes (full, partial, or none) depend on order status, delivery status, and Shopify financial status. You will be notified when applicable via the app, email, or push. 

Returns, RMA, and Refunds 

Returns are managed through our Return Merchandise Authorization (RMA) process. 

Eligibility 

  • Returns may be submitted only for delivered orders. 

  • Requests must be submitted within 10 days of the recorded delivery date. 

  • Returns apply to product line items only. Delivery charges, service fees, sales-tax-only lines, and similar fee-only items are not eligible as standalone returns. 

  • Each RMA must include between 1 and 5 photos (and any additional evidence we request). You must provide accurate order, product, quantity, and reason information. 

Warranty disclaimer 

By submitting an RMA, you confirm acceptance of our return disclaimer, including that labor is not covered and that warranty coverage is part-to-part only, unless otherwise stated in writing for a specific case.

Refund calculations depend on the return reason and operational review:

Displayed return summaries in the app are estimates; final approval, inspection results, partial quantities, and refund execution are determined after admin/sales review and Shopify refund processing. 

RMA process and communications 

  • New RMAs are submitted in REQUESTED status and are not auto-approved. 

  • Status may progress through review, assignment, return shipment, receipt, inspection, refund pending, refunded, closed, rejected, or cancelled, as applicable. 

  • Customers, assigned sales representatives, and administrators may exchange messages and images on an RMA where status allows. 

  • Refunds are initiated through our commerce integration; refund status may show as pending, succeeded, or failed. Failed refunds may require manual follow-up. 

We may reject, cancel, or limit returns that are outside policy, abusive, fraudulent, or unsupported by evidence. 

Support 

Customers may open support tickets in the app. Staff may respond via ticket messaging. You may also contact info@exhaustexpert.com for support. Support does not replace emergency or safety-critical vehicle repair decisions. 

Notifications 

With your device permissions, we may send push notifications (for example via our push provider) and in-app notifications about orders, deliveries, RMAs, account requests, and support. You can manage device notification settings through your OS; some transactional messages may still be sent by email as part of the Services. 

Account Deletion 

Customers and sales representatives may request account deletion from profile settings. 

How deletion works 

  1. You confirm the request in the app and verify your identity with a 6-digit code sent to your email (codes expire after a limited time, currently 15 minutes). 

  1. After verification, a pending deletion request is created for administrator review. You will receive email confirmation that the request was received. 

  1. An administrator may approve or decline the request. You will be emailed the outcome. If declined, you may continue using the Services unless otherwise restricted. 

Deletion is not completed immediately upon OTP entry. 

Effect of approved deletion 

When an administrator approves deletion: 

  • Your account access is disabled and login sessions/tokens are revoked. 

  • Personal profile fields (such as name, email, phone, and saved addresses) are anonymized or removed in our systems. 

  • If linked, Shopify customer personal data may be anonymized in accordance with our integration. 

  • Certain records (including orders, payments, refunds, RMAs, support tickets, audit logs, and legal/compliance records) may be retained as required by law, tax, anti-fraud, dispute resolution, or legitimate business operations. 

Administrators and warehouse administrators cannot self-delete through this in-app flow; contact info@exhaustexpert.com for assistance. 

Intellectual Property 

The app, software, logos, content, and related materials are owned by Exhaust Expert or its licensors and protected by intellectual property laws. Except as expressly allowed by these Terms or separate written permission, you may not copy, modify, distribute, sell, or create derivative works from the Services. 

Vehicle and Product Information 

Vehicle lookup (including VIN decode and manual vehicle selection) and product fitment/compatibility information are provided for convenience only. You are responsible for verifying correct parts, specifications, and installation requirements for each job. Exhaust Expert does not guarantee that lookup results are complete, current, or error-free. 

Disclaimers 

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 

We do not warrant uninterrupted, secure, or error-free operation, or that orders, deliveries, refunds, or third-party integrations will always meet your expectations or deadlines. 

Limitation of Liability 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXHAUST EXPERT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES. 

OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100, UNLESS APPLICABLE LAW REQUIRES OTHERWISE. 

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law. 

Indemnification 

You agree to indemnify and hold harmless Exhaust Expert and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Services, violation of these Terms, or violation of any third party’s rights. 

Suspension and Termination 

We may suspend or terminate access immediately for violations of these Terms, legal requirements, fraud prevention, or operational/security needs. You may stop using the Services at any time. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive termination. 

Governing Law and Disputes 

These Terms are governed by the laws of the United States and the state in which Exhaust Expert primarily operates, without regard to conflict-of-law rules, except where mandatory local consumer law applies. 

Disputes will be resolved in the competent courts of that jurisdiction, unless applicable law requires a different forum. 

Changes to Terms 

We may update these Terms from time to time. The revised version will be posted with an updated “Last updated” date. Material changes may also be communicated through the app or email where appropriate. Continued use after the effective date constitutes acceptance of the updated Terms, where permitted by law.
